Contest Rules and Regulations

The company Mouratoglou Academy, hereinafter “MA”, whose registered office is located at 37 Rue de la Pérouse, 75016 Paris, registered with the Paris Trade and Companies Registry under number 410 939 136, offers an online game (hereinafter the “Game” or “Contest”).

The games organized on the MA Facebook page are free and with no obligation to purchase. They are available on MA’s Facebook gaming platform at the following address : https://www.facebook.com/Mouratoglou-Tennis-Academy-174896646716/ (hereinafter the “Platform”).

By taking part in the various Contests via the Platform, the Participants may have access to a draw allowing one or more of them to win a prize, the nature of which is indicated in each Contest publication concerned.

The Contest Game is developed and managed by MA only. The company Facebook only hosts the Contest within the Platform and does not intervene in any other way. The Platform cannot be held liable in any way whatsoever.

The present document contains the rules of the Contest (hereinafter the “Rules”). They are made available and accessible to all Participants during the Contest Period in the “Articles” tab on MA’s Facebook page.

All persons are deemed to have read, understood and accepted, without reservation, the Rules in their entirety.

Article 1: Conditions of access

1.1.

Participation in the Contest is open to any person meeting the cumulative conditions below:

(i) natural person, having the capacity to contract (i.e. any person of full age, any emancipated minor and any person not subject to a guardianship measure)

(ii) with Internet access and a valid personal e-mail address,

(iii) with a Facebook account and access to the Contest via the Platform for the duration indicated in the publication of the Contest concerned.

MA will, within the means at its disposal, verify the Participants’ compliance with these criteria. In the event that one of these criteria is not met, registration to the Contest will not be valid and MA reserves the right to exclude during the execution of the Contest any Participant who does not comply with these conditions.

1.2.

Participation in the Contest is limited to one entry in the draw as detailed in article 2 below.

Access to the Contest is forbidden to employees of MA and to any natural or legal person having collaborated or collaborating in the organization of the Contest, including members of their close family (e.g. spouse, partner, child, sister and brother, parent, PACS partner).

Article 2: Participation

2.1.

To register for the draw and attempt to win the prizes set out in article 3.1, any Participant must have carried out the actions mentioned below:

– Go to one of the dedicated publications

– Follow the detailed participation instructions in the dedicated publication

– Read, understand and fully accept the Contest Rules and Regulations available in the “Articles” tab on MA’s Facebook page

Registration to the draw is effective only after completion of these steps.

Each Participant undertakes to communicate correct information concerning him/her. MA cannot be held responsible in the event that a Participant uses false names and/or first names associated with a valid e-mail address, or even usurps the identity of a third party.

2.2.

Participation in the Contest is carried out exclusively by electronic means on the Platform, with the drawing of prizes being carried out among the Participants registered for the Contest.

Any participation in the Contest on plain paper or in any other form is excluded.

2.3.

Participation in the Contest will only be valid if the information required by MA is complete and correct.

Any entries made through the use of incorrect or falsified information will automatically forfeit any right to any winning prize.

2.4.

Each Participant agrees to abide by the Rules. The non-respect of the Rules by the Participant, and in particular any fraud, abuse, cheating, purchase of clicks, may lead to exclusion from the Contest by decision of MA.

In addition, in the event of abuse or cheating by one or more Participants, MA reserves the right to modify or terminate the Contest without prior notice, including where the integrity of the Contest is in question.

Article 3: Determination of winners – prizes collection

3.1. Determination of winners

The winner(s) will be determined by a random draw from the database of all entrants registered in the draw via Facebook.

The draw will take place on the date mentioned in the dedicated publication.

3.2. Lots

The winner(s) will win the prize indicated in the dedicated publication available on the Platform. Participants may not claim any compensation or consideration whatsoever in the event of cancellation or loss other than any consideration offered by the organizer. The prize offered may not give rise to any dispute of any kind, nor to the remittance of the cash equivalent, nor to the exchange or replacement for any reason whatsoever by MA. If circumstances so require, MA reserves the right to replace the prize with other prizes of equivalent value.

3.3. Informing winners/prize collection

MA will notify the winners by email or telephone, or by a mention on the MA Facebook page following the draw. On this occasion, the winners will be notified of the terms and conditions for the awarding of their prize.

When the characteristics of the prize require it, the winners will have to withdraw their prize from and until the date indicated in the communication sent by MA. If the winners do not withdraw their prize within the time limit indicated, they will lose their prize without MA being held responsible, nor any compensation being due to them. In the case of a non-electronic prize, the delivery of the latter will be carried out within 90 days from the date of designation of the winner, at the winner’s residence at MA’s expense.

MA reserves the right to keep the prizes that should have been awarded to the defaulting winner and to dispose of them as it sees fit.

Article 4: Modification and termination of the Contest

4.1.

MA reserves the right to shorten, extend, modify or cancel the Contest in the event of a case of force majeure that would make it impossible to continue the Contest in accordance with the Rules and in particular in the event of a malfunction of the Internet network (due to a virus or not), of the Platform or any other problem related to (tele)communication networks, means, and services, computers (online or offline), servers, Internet access and/or hosting providers, computer equipment or software, data or databases.

4.2.

In the event of such cancellation, modification, extension or reduction of the duration of the Contest, MA undertakes to notify the Participants by e-mail and/or by publication on the Platform and, if applicable, to communicate to them the new applicable rules or the new closing date of the Contest.

In the event of a modification of the present Rules with regard to the previous mentions, participation in the Contest under the modified conditions will be acquired by the simple fact of the non-opposition of the Participants already registered, it being specified that each Participant has in any case the possibility to unsubscribe from the Contest by contacting MA at any time before the closing date.

4.3.

In the event of such a modification of the terms and conditions of the Contest, cancellation, interruption or reduction of the duration of the Contest, MA cannot be held responsible and the Participants cannot claim any compensation, which they accept.

4.4.

Each Participant agrees that MA may terminate or modify the Contest at any time in the event that MA becomes aware of a significant amount of abuse, fraud or cheating in connection with the Contest registration or the operation of the Contest.

The cancellation or modification of the Contest will be communicated to the Participants by publication on the Platform or by any other means MA deems appropriate.

Article 5: Exemption and limitation of liability

MA shall not be liable for any damages, direct or indirect, regardless of their cause, origin, nature or consequences, even if MA has been advised of the possibility of such damages, caused by:

(i) a malfunction of the Internet network or computer equipment, including the Platform and the application (hardware and/or software and/or databases and/or data) of a Participant or of any person or company linked to the organization of the Contest or, more generally, any other problem related to the networks, means and services of (tele)communications, computers (online or offline), servers, Internet access and/or hosting providers, computer equipment or software, databases and data of any person;

(ii) the truthfulness of the information given by the Participant, and which it could not validly consider as not complying with the provisions of the present Rules with regard to the information and means in its possession;

(iii) any manufacturing defect, breakdown or other malfunction, regarding the conformity of the products or the safety of use of the products offered (under normal conditions of use) that are not its own products.

MA declines all responsibility for damage caused by events beyond its control, resulting from the use of the products or services of a supplier.

Article 6: Participation fees

The Contest is free of charge and with no obligation to purchase.

Insofar as the majority of Internet service providers offer a free or flat-rate connection to Participants, it is expressly agreed that any access to the Platform to participate in the Contest (such as, in particular, cable, ADSL, fiber or mobile Internet connections), shall not give rise to any reimbursement. Indeed, the Participants subscribe to the services of the Internet service provider for their use of the Internet in general, and the fact that the Participants connect to the Platform in order to participate in the Contest does not entail any additional costs.

Article 7: Dispute

In the event of a dispute or complaint regarding the Contest for any reason whatsoever, requests must be sent by e-mail to marketing@mouratoglou.com or by registered mail with return receipt requested to MA at the address mentioned in the introduction, for the duration of the Contest and maximum within sixty (60) days after the designation of the winners.

In the event of a dispute or complaint regarding the prizes awarded, requests must be sent in writing to the attention of MA, by e-mail to marketing@mouratoglou.com or by registered mail with acknowledgement of receipt to the address mentioned in the introduction within seven (7) days after receipt of the prize confirmation.

Each Participant undertakes, in the event of any difficulty that may arise regarding the application or interpretation of the Rules, to make an amicable appeal to MA prior to any legal action against the latter.

The Regulations are subject to French law. If the Participant is a consumer whose habitual residence is located in a country of the European Union, the Participant also benefits from rights protecting him/her under the mandatory provisions of the law in his/her country of residence. In the event that no amicable solution is found between the Participant(s) and MA, any dispute arising from these Rules will be submitted to the French courts.

Article 8: Personal data

MA takes privacy and the protection of personal data very seriously. Therefore, MA undertakes to implement adequate measures to ensure the protection, confidentiality and security of the Participants’ personal data and to process such data in accordance with the applicable provisions and in particular with the European Regulation n°2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“GDPR”) and/or any other provisions of applicable national legislation (together the “Applicable Regulations”).

MA is responsible for the processing of personal data using the Participant’s personal data collected during registration and participation in the Contest.

All the information requested in the Contest registration form is mandatory and mentioned as such. Failure by the Participant to answer will prohibit him/her from participating in the Contest.

The data collected is strictly necessary for the proper execution of the Contest. Therefore, the processing of the data collected during the Contest is necessary for the execution of pre-contractual measures and the contract between MA and the Participants.

MA may publish and reproduce on the Platform the image, the recording of the voice and the name of the winner, as long as the latter consents to it upon MA’s express request.

The Participant’s personal data collected will only be accessible to MA employees and companies of the Mouratoglou group in their capacity as co-organizers. The Participant’s personal data shall be kept, on the territory of the European Union, for the duration of the Contest and for a period of one (1) year after the end of the Contest.

Any Participant also has the right to access, rectify, erase, portability of data concerning him/her and the right to limit processing.

Each Participant also has the right to send MA specific instructions concerning the fate of his/her personal data after his/her death.

All of these rights can be exercised by contacting MA and its Data Protection Officer directly by e-mail at rgpd@mouratoglou.com or by post at the address mentioned in the introduction.

Finally, the Participant has the right to file a complaint with a competent control authority (in France the Commission Nationale de l’Information et des Libertés) to question MA’s personal data protection and privacy practices. However, MA invites Participants to contact MA at the contact details provided in the Introduction before lodging any complaint with the competent supervisory authority.

It is further specified that any request for deletion of such data by any means whatsoever during the Contest period may result in the cancellation of the registration to the Contest.

In the event that the Participant expressly indicates his/her wish to receive the MA Newsletter, the data transmitted will then also be processed by the Mouratoglou Group for the purposes of surveys, analyses or within the framework of commercial operations by MA, its subsidiaries, its commercial network and/or any company offering a service on behalf of MA.
